Cancellation of the transfer of assets to the management of the National Agency of Ukraine

In accordance with paragraph 7, part 6, article 100 of the Criminal Procedure Code of Ukraine, material evidence worth more than 200 subsistence minimums for able-bodied persons (about UAH 0.5 million) , if possible without prejudice to criminal proceedings, shall be transferred with the written consent of the owner, and in its absence - by decision of the investigating judge, court to the National Agency of Ukraine for the Identification, Search and Management of Assets Obtained from Corruption and Other Crimes, for the implementation of measures to manage them in order to ensure their preservation or preservation of their economic value.
In accordance with Part 1 of Article 19 of the Law of Ukraine “On the National Agency of Ukraine for the Identification, Search and Management of Assets Obtained from Corruption and Other Crimes”, the National Agency manages assets that have been seized in criminal proceedings, including as a measure to secure a claim - only in relation to a claim filed in the interests of the state, with the establishment of a ban on the disposal and/or use of such assets, the amount or value of which is equal to or exceeds 200 times the minimum wage established on January 1 of the relevant year.

That is, from the requirements of the specified article it is seen that the amount or value of assets must be equal to or exceed 200 minimum wages as of January 1, while Article 100 of the Code of Civil Procedure of Ukraine establishes the requirement to recognize assets as tangible evidence worth more than 200 subsistence minimums for able-bodied persons.
